1. Acceptance of Terms

By accessing or using our website, submitting inquiries, or purchasing products, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our website or services. We reserve the right to modify these Terms at any time, and changes will be effective upon posting to this page.

2. Product Descriptions

We strive to provide accurate product descriptions, specifications, and images on our website. However, we do not warrant that product descriptions, colors, dimensions, or other content on the site are complete, accurate, or error-free. Products may vary slightly from images shown.

All specifications and features are subject to change without notice. Custom configurations may have different specifications than standard models shown on the website. Final specifications will be confirmed in your order documentation.

3. Pricing

All prices displayed on our website are in US Dollars and are subject to change without notice. Prices do not include shipping, installation, taxes, or duties unless specifically stated.

Custom quotes provided by our sales team are valid for 30 days from the date of issuance unless otherwise specified. We reserve the right to correct pricing errors and to cancel any orders placed at an incorrect price.

4. Ordering and Payment

By placing an order, you are making an offer to purchase products subject to these Terms. We reserve the right to accept or decline any order. An order is confirmed only when we issue a written order confirmation or invoice.

Payment terms will be specified in your quote or order confirmation. Standard payment terms require a deposit upon order placement, with the balance due prior to shipment. Accepted payment methods include wire transfer, ACH, and major credit cards.

5. Shipping and Delivery

Standard lead times are 3-8 weeks for most products. Custom configurations may require additional time. Delivery dates are estimates and are not guaranteed.

Shipping costs are calculated based on order size, weight, and destination. Freight shipping is arranged by Gatestile, and the customer is responsible for receiving and inspecting the shipment.

Risk of loss transfers to the buyer upon delivery to the carrier. Please inspect all shipments upon receipt and report any damage or discrepancies within 48 hours.

6. Returns and Refunds

Due to the custom nature of our products, all sales are generally considered final. Returns may be accepted on a case-by-case basis for standard (non-custom) products within 30 days of delivery, subject to the following conditions:

• Products must be unused, in original packaging
• A Return Merchandise Authorization (RMA) number must be obtained prior to return
• Customer is responsible for return shipping costs
• A restocking fee of up to 20% may apply

Defective products will be repaired or replaced under our warranty at no charge. Please contact us to initiate a warranty claim.

7. Warranty

Gatestile provides a 5-year limited warranty on all products against defects in materials and workmanship under normal use and conditions. This warranty covers:

• Mechanical and electrical components
• Structural integrity of housings and barriers
• Control board and sensor functionality

This warranty does not cover:

• Damage from misuse, abuse, or unauthorized modification
• Normal wear and tear (e.g., glass scratches, surface scuffs)
• Damage from power surges, floods, or other acts of nature
• Products installed by unauthorized parties without Gatestile oversight

Warranty claims must be submitted in writing to our support team. Gatestile will, at its discretion, repair or replace defective products or components.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Gatestile Systems shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of our products or services.

Our total liability for any claim arising under these Terms shall not exceed the total amount paid by you for the specific product or service giving rise to the claim.

9. Intellectual Property

All content on this website, including text, images, graphics, logos, product designs, and software, is the property of Gatestile or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without written permission.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Kings County, New York.

11. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will remain in full force and effect.
